Sir C. MacDonald to Sir Edward Grey.--(Received October 28.)
Tokió, October 3, 1907. IN accordance with the instructions contained in your despatch No. 121 of the 31st May, received here on the 21st July, I addressed a note to the Minister for Foreign Affairs, inquiring whether the Japanese Government were willing to draw up a draft Convention for the mutual protection of their respective subjects in the matter of trade-marks in China, now that their wishes had been met by His Majesty's Govern- ment with regard to the points which had previously stood in the way of such an agreement. I subsequently mentioned the matter to Count Hayashi, who informed me that it was receiving the prompt attention of the competent authorities.
On receipt yesterday of your telegram No. 35, I at once addressed a private letter to his Excellency inquiring how the matter stood, and asking him to be so good as to look the question up before I attended his weekly reception to-day. Count Hayashi was not in Tokió as usual, but I saw the Vice-Minister for Foreign Affairs who, as already reported in my telegram No. 43 of to-day's date, informed me that the Convention had been already drafted and was now before the Law Officers of the Crown, previous to its being presented to the Cabinet. He added that Count Hayashi was doing all in his power to expedite matters.
A copy of this despatch has been sent to His Majesty's Minister at Peking.
